Parent Contract Please read through the contract and fill it out to acknowledge acceptance and receipt. 1. Retainer and Payment. Parent of Senior (heretofore known as Client) is required to pay a standard non-refundable Senior Portrait retainer of $150, $250 or $370 depending on session chosen. This retainer is applied toward the Senior Session fees for the session itself. No products are included in this fee. Product list can be viewed at http://jlpwv.com/JLP%20Senior%20Investment.pdf 2. Cancellation. If client fails to appear for session without 24 hours notice, there will be no session rescheduled. Rescheduling * If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. 3. Photographic Materials. All photographic materials, including but not limited to negatives or digital files, transparencies, proofs, and previews, shall be the exclusive property of the Photographer. Photographer shall make previews available to the Client for the purpose of selecting photographs should they decide to purchase. 4. Copyright and Release. The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, for display, or any other business use. 5. Client’s Usage. Client may use the watermarked images ONLY on social media. Modification, cropping, or removal of watermark will result in legal action. 6. Arbitration. All disputes arising under Agreement shall be submitted to binding arbitration before a judge in West Virginia courts and the arbitration award may be entered for judgment in any court having jurisdiction thereof. Notwithstanding the foregoing, either party may refuse to arbitrate when the dispute is for a sum less than $1000. 7. Miscellaneous. This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. 8. Model Release. The PHOTOGRAPHER reserves the right to use images created under this contract for advertising, display, publication or other purposes. The Client signing this contract warrants that he or shee has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the PHOTOGRAPHER in the event of litigation arising out of such use. Negatives, digital files and previews remain the exclusive property of the PHOTOGRAPHER. 9. Archive of Session Images . After 2 years, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. 10. Damage . Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt. 11. Liability . Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. This Agreement shall be governed by the laws of the State of West Virginia. The parties have read this Agreement, agree to all its terms, and acknowledge receipt of a complete copy of the Agreement signed by both parties.
